Oracle respects your preferences concerning the collection and use of your Personal Information. The following privacy policies are tailored for the different ways your Personal Information may be collected, used, shared and processed by different Oracle lines of business:

  • The Oracle General Privacy Policy addresses information we collect in connection with your use of our websites and mobile applications, your interactions with Oracle and in the context of our offline sales and marketing activities, including Profit Magazine and Oracle Magazine.

Terms of Use

Welcome to the Oracle Web sites (the “Site”). Through the Site, you have access to a variety of resources and content. These include: (a) software and software as a service offerings (“Software”); (b) Web pages, data, messages, text, images, photographs, graphics, audio and video such as podcasts and Webcasts, and documents such as press releases, white papers and product data sheets (“Materials”); and (c) forums, discussion groups, chat areas, bulletin boards, blogs, wikis, e-mail functions, and other services in connection with which you can upload, download, share, email, post, publish, transmit or otherwise access or make available Content (as defined below) (“Community Services”). Software, Materials, Community Services, and other information, content and services are collectively referred to as “Content.” The following are terms of a legal agreement between you (“You” or “Your”) and Oracle Corporation and its affiliated companies (“We” or “Oracle”). By accessing or using the Site or the Content provided on or through the Site, you agree to follow and be bound by the following terms and conditions concerning your access to and use of the Site and the Content provided on or through the Site (“Terms of Use”) and our Privacy Policy. 1. Terms Applicable to Specific Content and Areas of the Site
Some areas of the Site or Content provided on or through the Site may have additional rules, guidelines, license agreements, user agreements or other terms and conditions that apply to your access or use of that area of the Site or Content (including terms and conditions applicable to a corporation or other organization and its users). If there is a conflict or inconsistency between these Terms of Use and the rules, guidelines, license agreement, user agreement or other terms and conditions for a specific area of the Site or for specific Content, the latter shall have precedence with respect to your access and use of that area of the Site or Content.

2. Use of Software
Your use of Software is subject to all agreements such as a license agreement or user agreement that accompanies or is included with the Software, ordering documents, exhibits, and other terms and conditions that apply (“License Terms”). In the event that Software is provided on or through the Site and is not licensed for your use through License Terms specific to the Software, you may use the Software subject to the following: (a) the Software may be used solely for your personal, informational, noncommercial purposes; (b) the Software may not be modified or altered in any way; and (c) the Software may not be redistributed.

3. Use of Materials
You may download, store, display on your computer, view, listen to, play and print Materials that Oracle publishes or broadcasts on the Site or makes available for download through the Site subject to the following: (a) the Materials may be used solely for your personal, informational, noncommercial purposes; (b) the Materials may not be modified or altered in any way; and (c) the Materials may not be redistributed.

4. Use of Community Services
Community Services are provided as a convenience to users and Oracle is not obligated to provide any technical support for, or participate in, Community Services. While Community Services may include information regarding Oracle products and services, including information from Oracle employees, they are not an official customer support channel for Oracle.

You may use Community Services subject to the following: (a) Community Services may be used solely for your personal, informational, noncommercial purposes; (b) Content provided on or through Community Services may not be redistributed; and (c) personal data about other users may not be stored or collected except where expressly authorized by Oracle.

5. Reservation of Rights
The Site and Content provided on or through the Site are the intellectual property and copyrighted works of Oracle or a third party provider. All rights, title and interest not expressly granted with respect to the Site and Content provided on or through the Site are reserved. All Content is provided on an “As Is” and “As Available” basis, and Oracle reserves the right to terminate the permissions granted to you in Sections 2, 3 and 4 above and your use of the Content at any time.

6. Your Content
You agree that you will only upload, share, post, publish, transmit, or otherwise make available (“Share”) on or through the Site Content that you have the right and authority to Share and for which you have the right and authority to grant to Oracle all of the licenses and rights set forth herein. By Sharing Content, you grant Oracle a worldwide, perpetual, royalty-free, irrevocable, nonexclusive, fully sublicensable license to use, reproduce, modify, adapt, translate, publish, publicly perform, publicly display, broadcast, transmit and distribute the Content for any purpose and in any form, medium, or technology now known or later developed. This includes, without limitation, the right to incorporate or implement the Content into any Oracle product or service, and to display, market, sublicense and distribute the Content as incorporated or embedded in any product or service distributed or offered by Oracle without compensation to you. You warrant that: (a) you have the right and authority to grant this license; (b) Oracle’s exercise of the rights granted pursuant to this license will not infringe or otherwise violate any third party rights; and (c) all so-called moral rights in the Content have been waived to the full extent allowed by law.

You agree that you will neither use the Site in a manner, nor Share any Content, that: (a) is false or misleading; (b) is defamatory, derogatory, degrading or harassing of another or constitutes a personal attack; (c) invades another’s privacy or includes, copies or transmits another’s confidential, sensitive or personal information; (d) promotes bigotry, racism, hatred or harm against any group or individual; (e) is obscene or not in good taste; (f) violates or infringes or promotes the violation or infringement of another’s rights, including intellectual property rights; (g) you do not have the right and authority to Share and grant the necessary rights and licenses for; (h) violates or promotes the violation of any applicable laws or regulations; (i) contains a solicitation of funds, goods or services, or promotes or advertises goods or services; or (j) contains any viruses, Trojan horses, or other components designed to limit or harm the functionality of a computer. Oracle may report you to the relevant authorities and may act under the fullest extent of applicable laws if you transmit or upload content intended or designed to cause harm.

Oracle does not want to receive confidential information from you through or in connection with the Site. Notwithstanding anything that you may note or state in connection with Sharing Content, it shall not be considered confidential information and shall be received and treated by Oracle on a non-confidential and unrestricted basis and Oracle shall not take and shall not be required to take any steps to safeguard the confidentiality of any information that you Share, other than as specified in Oracle’s Privacy Policy.

7. Security, Passwords and Means of Accessing the Site and Content
You agree not to access or use the Site in any manner that could damage, disable, overburden, or impair any Oracle accounts, computer systems or networks. You agree not to attempt to gain unauthorized access to any parts of the Site or any Oracle accounts, computer systems or networks. You agree not to interfere or attempt to interfere with the proper working of the Site or any Oracle accounts, computer systems or networks. You agree not to use any robot, spider, scraper or other automated means to access the Site or any Oracle accounts, computer systems or networks without Oracle’s express written permission.

If any of the Services require you to open an account, you must complete the registration process by providing us with current, complete and accurate information as required by the applicable registration form. You may also be required to choose a password and a user name. Access to and use of password protected or secure areas of the Site are restricted to authorized users only. You agree not to share your password(s), account information, or access to the Site with any other person. You are responsible for maintaining the confidentiality of password(s) and account information, and you are responsible for all activities that occur through the use of your password(s) or account(s) or as a result of your access to the Site. You agree to notify Oracle immediately of any use of your password(s) or account(s) that you did not authorize or that is not authorized by these Terms of Use.

8. No Unlawful or Prohibited Use
You agree not to use the Site, or Content provided on or through the Site, for any purpose that is unlawful or prohibited by these Terms of Use or the rules, guidelines or terms of use posted for a specific area of the Site or Content provided on or through the Site.

9. Indemnity
You agree to indemnify and hold harmless Oracle, its officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses or expenses, including reasonable attorneys’ fees and costs, due to or arising out of Content that you Share, your violation of these Terms of Use or any additional rules, guidelines or terms of use posted for a specific area of the Site or Content provided on or through the Site, or your violation or infringement of any third party rights, including intellectual property rights.

10. Monitoring
Oracle has no obligation to monitor the Site or screen Content that is Shared on or through the Site. However, Oracle reserves the right to review the Site and Content and to monitor all use of and activity on the Site, and to remove or choose not to make available on or through the Site any Content in its sole discretion. Oracle may remove Content that is confidential or proprietary to a third party without that third party’s permission.

11. Termination of Use
Oracle may, in its sole discretion, at any time discontinue providing or limit access to the Site, any areas of the Site or Content provided on or through the Site. You agree that Oracle may, in its sole discretion, at any time, terminate or limit your access to, or use of, the Site or any Content. Oracle may terminate or limit your access to or use of the Site if Oracle determines, in its sole discretion, that you have infringed the copyrights of a third party. You agree that Oracle shall not be liable to you or any third-party for any termination or limitation of your access to, or use of, the Site or any Content, including Content that you may have Shared.

12. Third Party Web Sites, Content, Products and Services
The Site provides links to Web sites and access to Content, products and services of third parties, including users, advertisers, affiliates and sponsors of the Site. Oracle is not responsible for third party Content provided on or through the Site or for any changes or updates to such third party sites, and you bear all risks associated with the access to, and use of, such Web sites and third party Content, products and services.

13. Disclaimer
EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE, THE SITE, AND ALL CONTENT PROVIDED ON OR THROUGH THE SITE, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ORACLE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT WITH RESPECT TO THE SITE AND ALL CONTENT PROVIDED ON OR THROUGH THE SITE. TO THE EXTENT THAT THEY ARE HELD TO BE LEGALLY INVALID, DISCLAIMERS, EXCLUSIONS AND LIMITATIONS SET FORTH IN THESE TERMS OF USE, INCLUDING THOSE SET FORTH IN SECTIONS 13 AND 14, DO NOT APPLY AND ALL OTHER TERMS SHALL REMAIN IN FULL FORCE AND EFFECT.

16. Privacy Policy
Oracle is concerned about your privacy and has developed a policy to address privacy concerns. For more information, please see Oracle’s Privacy Policy. Any personal information collected on this Site may be accessed and stored globally and will be treated in accordance with Oracle’s Privacy Policy. You understand that Oracle collects, uses, processes, possesses, and otherwise stores your personal information and utilization data and may share such data with third party service providers for the purpose of improving or providing services subject to Oracle’s Privacy Policy.

17. Persons Not of Age of Majority
Persons who are not of the age of majority are not eligible to use the Site, and we ask that no information in relation to such persons be submitted to us.

18. Export Restrictions/Legal Compliance
You may not access, download, use or export the Site, or the Content provided on or through the Site, in violation of U.S. export laws or regulations, or in violation of any other applicable laws or regulations. Reporting Piracy of Oracle Products

If you believe that Oracle software or documentation is being copied, sold or distributed without licenses or permission from Oracle, please contact the Legal Department at copyright_us@oracle.com.

Buying Oracle Software Through Online Auctions

Much of the Oracle software sold through online auctions is pirated or otherwise unauthorized. In addition to being sold illegally, such software may contain bugs, viruses or other errors that could seriously damage your computer systems.

Oracle makes virtually all of its most popular software freely available for trial downloads in the Oracle Store or through free membership in the Oracle Technology Network.

Use of Oracle Screenshots

Oracle’s software programs are copyrighted materials owned by Oracle. Screenshots constituting an image of an individual screen display from any Oracle software, application or service are protected by copyright. (See Oracle’s Trademark Guidelines for questions about use of our company name and logos).

If you want to use more than ten (10) screenshots in a published piece, such as a book or white paper, you will require a formal permission letter from Oracle. Please contact our Copyright team at copyright_us@oracle.com with information about your work, the screenshots needed, and a sample chapter for our review. We may approve your request if the screenshot content does not constitute more than 25% of the content of your work.

If you want to use ten (10) or fewer screenshots in a published piece, you may do so provided that you agree and adhere to the following terms:

  1. This permission constitutes a fully revocable, nonexclusive license and is not a transfer of ownership, title or any other right or interest in Oracle’s screenshots. Oracle may terminate permission at any time by notifying you of the termination of permission for your particular use. Oracle may revise or withdraw this general permission at any time without notice.
  2. Your use may not directly or indirectly state or imply Oracle sponsorship, affiliation or endorsement of your product, service, or published piece.
  3. Screenshots must be reproduced in their entirety and you may not alter screenshots in any way except to proportionally resize them. All added commentary and analysis relating to Oracle screenshots must be clearly attributable to you and not to Oracle.
  4. This permission does not apply to any Oracle screenshots that are from beta products or other products that are subject to non-disclosure obligations or that have not yet been commercially released.
  5. Oracle screenshots may not be incorporated into: comparative advertising; obscene, pornographic or sexually explicit materials; or materials which are, in Oracle’s sole opinion, disparaging or defamatory of Oracle, its products, or any other person or entity.
  6. Oracle expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement in connection with your use of Oracle screenshots. Your use of Oracle screenshots is at your own discretion and risk.

Third Party Usage Guidelines for Oracle Trademarks

Oracle’s trademarks and service marks (“Oracle trademarks”) are valuable assets that Oracle needs to protect. We ask that you help us by properly using and crediting Oracle trademarks in accordance with these guidelines. For information about proper use of Oracle logos, logotypes, signatures, and design marks, please review the Third Party Usage Guidelines for Oracle Logos.

Permissible Use

You may generally use Oracle trademarks to refer to the associated Oracle products or services. For instance, an authorized reseller can note in its advertisements that it is selling the Oracle application server. Similarly, an Oracle customer may issue a press release stating that it has implemented Oracle software.

Relationship of Products or Services
You may indicate the relationship of your products or services to Oracle products or services by using accurate, descriptive tag lines such as “for Oracle database,” “for use with Oracle E-Business Suite applications,” and “works with Oracle software” in connection with your product or service name. Within text or body copy, such tag lines may appear in the same type as your product or service name. On product, packaging, advertising and other collateral where your product or service name is displayed apart from body copy, make sure that the tag line appears in significantly smaller type than your name. You should also distinguish the tag line from your mark by using a different font or color. However, Oracle or the tag line should never appear in the Oracle red color. This is important to avert any implication that your product or service is produced or endorsed by Oracle.

Titles
Oracle permits use of its marks in single volume book titles (not magazines or periodicals) where such use is descriptive or referential. To avoid misleading the public as to Oracle sponsorship, affiliation or endorsement, the Oracle mark must not appear more prominently than the rest of the title, and do not use Oracle logos on the cover. In addition, we request that you include a disclaimer of association with Oracle on the copyright page.

Open Source Software
Most open source licenses do not grant, and many exclude, a license of trademark rights. Do not assume you can use the name of a source code base in the name of your distribution developed from that code base. Without a license or permission, you may not incorporate Oracle trademarks in the name of your distribution or other products that incorporate open source elements. Truthful statements incorporating a trademark are generally allowed (for example, in the format “MyImplementation, derived from Trademarked ProductName”), but you should check the terms of the license for the original source code or any posted trademark guidelines for the project.

User Groups
Oracle generally permits use of its marks in groups name that include phrases such as “user group,” “special interest group,” “lobby,” etc., that clarify the relationship between Oracle and the group and do not create confusion about the source of products. This applies only to user groups that are not formally doing business as commercial entities. If you are administering a user group that includes an Oracle trademark in its name, do not claim any trademark rights in the name or attempt to register the name or your logo with a trademark office, and do not register the name as a trade name or business name, or conduct any business under the name.

Prohibited Use

You may not use Oracle trademarks in a manner which could cause confusion as to Oracle sponsorship, affiliation or endorsement. Take particular care not to use Oracle marks as set out below.

Company, Product or Service Names
Do not use Oracle trademarks or potentially confusing variations as all or part of your company, product or service names. If you wish to note the relationship of your products or services to Oracle products or services, please use an appropriate tag line as detailed above. For example, “XYZ for Oracle database” not “OraXYZ or XYZ Oracle”

Logos
For more information regarding use of Oracle logos, please review the Third Party Usage Guidelines for Oracle Logos.

Trade Dress
You must not imitate Oracle trade dress, type style or logos. For instance, do not copy Oracle packaging for use with your product or display your product name in the distinctive logotype associated with the Oracle logo.

Domain Names
Do not use Oracle trademarks or potentially confusing variations in your Internet domain name. This helps prevent Internet users from being confused as to whether you or Oracle is the source of the Web site.

Correct Use

Proper use of Oracle trademarks reinforces their role as brands for our products and services, and helps prevent them from becoming generic names that can be used by anyone. Examples of former trademarks that became generic terms are “aspirin,” “cellophane,” and “escalator.” By adhering to the following rules, you help protect Oracle’s investment in its trademarks.

Use a Generic Term
Use a generic term in association with each Oracle trademark the first time the mark appears in text, and as often as possible after that. You need not include generic names in headlines, package titles and documentation titles. For example, “Oracle iLearning software”, “Oracle On Demand services”, and “Oracle database.”

Use as Adjectives
Oracle trademarks are adjectives and should not be used as nouns, or in the possessive or plural form. For example, “Oracle database’s benefits..” not “Oracle’s benefits…”

Avoid Variations
Do not vary Oracle trademarks by changing their spelling or abbreviating them. For example, “Oracle Collaboration Suite” not “CollabSuite.”

Trademark Symbols and Credit Lines

Proper trademark attribution through trademark symbols and credit lines helps makes the public aware of our trademarks, and helps prevent them from becoming generic terms. Credit lines also help clarify that they belong to Oracle. Accordingly, Oracle would appreciate you attributing ownership of Oracle trademarks to Oracle Corporation by using trademark symbols (™ or SM or ®) and credit lines as detailed below.

Trademark Symbols
Use the ® symbol with the most prominent appearance of the “Oracle” mark on products, packaging, manuals, advertisements, promotional materials and Web pages (for example, in the headline of an advertisement), and the first use of the mark in text or body copy. This includes situations where “Oracle” is a part of a product or service name (for example, Oracle® Collaboration Suite, Oracle® PartnerNetwork). You do not need to use trademark symbols with other Oracle trademarks.

Example: XYZ Develops New Product for Oracle® Database
XYZ Corporation, a member of the Oracle® PartnerNetwork program, has developed the ABC software cartridge for use with the industry leading Oracle database. The ABC software cartridge is one of numerous products XYZ has developed that complement leading Oracle offerings.

“Oracle” receives a trademark symbol in the headline because this is the most prominent appearance, and when it appears as part of the “Oracle PartnerNetwork” name because this is the first appearance in text. While there is no trademark symbol after “Oracle” when it appears in front of the term “products” and “offerings” since we already used a symbol the first time that the term “Oracle” appeared in body copy. It is always acceptable to continue using the ® after “Oracle” throughout the document.

Credit Line
All products, packaging, manuals, advertisements, promotional materials and Web pages bearing Oracle trademarks should include the following trademark credit line.

“Oracle and Java are registered trademarks of Oracle and/or its affiliates. Other names may be trademarks of their respective owners.”

The credit line may appear anywhere on the collateral, but typically is displayed on a copyright page, the back of a package or at the end of a document or web page.

“Oracle” As a Trade Name

Trade names are the actual business names of companies. Trademarks and trade names are not the same, even though many companies use their trade names as trademarks. If you are using “Oracle” as a substitute for Oracle Corporation, you are using it as a trade name. Because they are nouns, trade names can be used in the possessive and do not require a generic term or a trademark symbol. Thus, you should not use a ® after “Oracle” when it appears as part of the full corporate name or as a trade name.

Examples

  • Corporate Name: This software was developed by Oracle Corporation.
  • Trade Name: This software was developed by Oracle.
  • Trade Name: Oracle’s latest software developments are outstanding.
  • Trademark: The Oracle® database leads the industry.

Third Party Usage Guidelines for Oracle Logos

Oracle’s logos, logotypes, signatures and design marks (“Oracle logos”) are valuable assets that Oracle needs to protect. Accordingly, we ask that you follow these guidelines with respect to Oracle logos. Remember that you are generally not able to use Oracle logos unless you are specifically licensed or authorized to use them. Information regarding Logo programs under which you may be licensed to use Oracle logos and information on obtaining other authorization is set out below.

Logo Programs

Qualified third parties are able to license the right to use select Oracle logos under Oracle logo programs. More information on these programs can be found by going to the web pages set out below or emailing the referenced email addresses.

  • A written summary setting forth: (a) your name and your company’s name; (b) contact information including phone number, fax number, email address and mailing address; (c) the specific Oracle logo that you wish to use; (d) background information on your company, detailing any relationship with Oracle; (e) the names of any Oracle contacts; (f) a description of your proposed use of the logo, including why you want to use the logo, where the logo would appear, the duration and geographical extent of the proposed use, how the logo would be displayed relative to your corporate name and logo, and whether the Oracle logo would be one of various logos appearing; (g) a description of Oracle’s involvement in any program or project in association with which you propose to use the Oracle logo; and (h) any previous correspondence you have had with Oracle regarding this logo request.
  • A mock-up or sample drawing showing your proposed use.

Following submission, Oracle will evaluate the request and contact you if additional information is necessary. You will then be notified whether the request is approved. The normal turnaround time for such requests is one week. If approval is granted, you will be sent formal written authorization to use the logo, electronic artwork and usage guidelines where appropriate.

Proper Use

Third parties expressly licensed or authorized to use Oracle logos must not alter or modify them in any way. Make sure to use Oracle approved artwork and refer to the appropriate identity guidelines provided by Oracle. Use must comply with the terms and conditions of your license or Oracle’s authorization.

Oracle does not want to receive confidential information from you through or in connection with the Site. Notwithstanding anything that you may note or state in connection with Sharing Content, it shall not be considered confidential information and shall be received and treated by Oracle on a non-confidential and unrestricted basis and Oracle shall not take and shall not be required to take any steps to safeguard the confidentiality of any information that you Share, other than as specified in Oracle’s Privacy Policy.

7. Security, Passwords and Means of Accessing the Site and Content
You agree not to access or use the Site in any manner that could damage, disable, overburden, or impair any Oracle accounts, computer systems or networks. You agree not to attempt to gain unauthorized access to any parts of the Site or any Oracle accounts, computer systems or networks. You agree not to interfere or attempt to interfere with the proper working of the Site or any Oracle accounts, computer systems or networks. You agree not to use any robot, spider, scraper or other automated means to access the Site or any Oracle accounts, computer systems or networks without Oracle’s express written permission.

If any of the Services require you to open an account, you must complete the registration process by providing us with current, complete and accurate information as required by the applicable registration form. Buying Oracle Software Through Online Auctions

Much of the Oracle software sold through online auctions is pirated or otherwise unauthorized. In addition to being sold illegally, such software may contain bugs, viruses or other errors that could seriously damage your computer systems.

Oracle makes virtually all of its most popular software freely available for trial downloads in the Oracle Store or through free membership in the Oracle Technology Network.

Use of Oracle Screenshots

Oracle’s software programs are copyrighted materials owned by Oracle. Screenshots constituting an image of an individual screen display from any Oracle software, application or service are protected by copyright. (See Oracle’s Trademark Guidelines for questions about use of our company name and logos).

If you want to use more than ten (10) screenshots in a published piece, such as a book or white paper, you will require a formal permission letter from Oracle. Please contact our Copyright team at copyright_us@oracle.com with information about your work, the screenshots needed, and a sample chapter for our review. We may approve your request if the screenshot content does not constitute more than 25% of the content of your work.

If you want to use ten (10) or fewer screenshots in a published piece, you may do so provided that you agree and adhere to the following terms:

  1. This permission constitutes a fully revocable, nonexclusive license and is not a transfer of ownership, title or any other right or interest in Oracle’s screenshots. Oracle may terminate permission at any time by notifying you of the termination of permission for your particular use. Oracle may revise or withdraw this general permission at any time without notice.
  2. Your use may not directly or indirectly state or imply Oracle sponsorship, affiliation or endorsement of your product, service, or published piece.
  3. Screenshots must be reproduced in their entirety and you may not alter screenshots in any way except to proportionally resize them. All added commentary and analysis relating to Oracle screenshots must be clearly attributable to you and not to Oracle.
  4. This permission does not apply to any Oracle screenshots that are from beta products or other products that are subject to non-disclosure obligations or that have not yet been commercially released.
  5. Oracle screenshots may not be incorporated into: comparative advertising; obscene, pornographic or sexually explicit materials; or materials which are, in Oracle’s sole opinion, disparaging or defamatory of Oracle, its products, or any other person or entity.

Trademarks

Third Party Usage Guidelines for Oracle Trademarks

Oracle’s trademarks and service marks (“Oracle trademarks”) are valuable assets that Oracle needs to protect. We ask that you help us by properly using and crediting Oracle trademarks in accordance with these guidelines. For information about proper use of Oracle logos, logotypes, signatures, and design marks, please review the Third Party Usage Guidelines for Oracle Logos.

Permissible Use

You may generally use Oracle trademarks to refer to the associated Oracle products or services. For instance, an authorized reseller can note in its advertisements that it is selling the Oracle application server. Similarly, an Oracle customer may issue a press release stating that it has implemented Oracle software.

Relationship of Products or Services
You may indicate the relationship of your products or services to Oracle products or services by using accurate, descriptive tag lines such as “for Oracle database,” “for use with Oracle E-Business Suite applications,” and “works with Oracle software” in connection with your product or service name. Within text or body copy, such tag lines may appear in the same type as your product or service name. On product, packaging, advertising and other collateral where your product or service name is displayed apart from body copy, make sure that the tag line appears in significantly smaller type than your name. You should also distinguish the tag line from your mark by using a different font or color. However, Oracle or the tag line should never appear in the Oracle red color. This is important to avert any implication that your product or service is produced or endorsed by Oracle.

Titles
Oracle permits use of its marks in single volume book titles (not magazines or periodicals) where such use is descriptive or referential. To avoid misleading the public as to Oracle sponsorship, affiliation or endorsement, the Oracle mark must not appear more prominently than the rest of the title, and do not use Oracle logos on the cover. In addition, we request that you include a disclaimer of association with Oracle on the copyright page.

Open Source Software
Most open source licenses do not grant, and many exclude, a license of trademark rights. Do not assume you can use the name of a source code base in the name of your distribution developed from that code base. Without a license or permission, you may not incorporate Oracle trademarks in the name of your distribution or other products that incorporate open source elements. Truthful statements incorporating a trademark are generally allowed (for example, in the format “MyImplementation, derived from Trademarked ProductName”), but you should check the terms of the license for the original source code or any posted trademark guidelines for the project.

User Groups
Oracle generally permits use of its marks in groups name that include phrases such as “user group,” “special interest group,” “lobby,” etc., that clarify the relationship between Oracle and the group and do not create confusion about the source of products. This applies only to user groups that are not formally doing business as commercial entities. If you are administering a user group that includes an Oracle trademark in its name, do not claim any trademark rights in the name or attempt to register the name or your logo with a trademark office, and do not register the name as a trade name or business name, or conduct any business under the name.

Prohibited Use

You may not use Oracle trademarks in a manner which could cause confusion as to Oracle sponsorship, affiliation or endorsement. Take particular care not to use Oracle marks as set out below.

Company, Product or Service Names
Do not use Oracle trademarks or potentially confusing variations as all or part of your company, product or service names. If you wish to note the relationship of your products or services to Oracle products or services, please use an appropriate tag line as detailed above. For example, “XYZ for Oracle database” not “OraXYZ or XYZ Oracle”

Logos
For more information regarding use of Oracle logos, please review the Third Party Usage Guidelines for Oracle Logos.

Trade Dress
You must not imitate Oracle trade dress, type style or logos. For instance, do not copy Oracle packaging for use with your product or display your product name in the distinctive logotype associated with the Oracle logo.

Domain Names
Do not use Oracle trademarks or potentially confusing variations in your Internet domain name. This helps prevent Internet users from being confused as to whether you or Oracle is the source of the Web site.

Correct Use

Proper use of Oracle trademarks reinforces their role as brands for our products and services, and helps prevent them from becoming generic names that can be used by anyone. Examples of former trademarks that became generic terms are “aspirin,” “cellophane,” and “escalator.” By adhering to the following rules, you help protect Oracle’s investment in its trademarks.

Use a Generic Term
Use a generic term in association with each Oracle trademark the first time the mark appears in text, and as often as possible after that. You need not include generic names in headlines, package titles and documentation titles. For example, “Oracle iLearning software”, “Oracle On Demand services”, and “Oracle database.”

Use as Adjectives
Oracle trademarks are adjectives and should not be used as nouns, or in the possessive or plural form. For example, “Oracle database’s benefits..” not “Oracle’s benefits…”

Avoid Variations
Do not vary Oracle trademarks by changing their spelling or abbreviating them. For example, “Oracle Collaboration Suite” not “CollabSuite.”

Trademark Symbols and Credit Lines

Proper trademark attribution through trademark symbols and credit lines helps makes the public aware of our trademarks, and helps prevent them from becoming generic terms. Credit lines also help clarify that they belong to Oracle. Accordingly, Oracle would appreciate you attributing ownership of Oracle trademarks to Oracle Corporation by using trademark symbols (™ or SM or ®) and credit lines as detailed below.

Trademark Symbols
Use the ® symbol with the most prominent appearance of the “Oracle” mark on products, packaging, manuals, advertisements, promotional materials and Web pages (for example, in the headline of an advertisement), and the first use of the mark in text or body copy. This includes situations where “Oracle” is a part of a product or service name (for example, Oracle® Collaboration Suite, Oracle® PartnerNetwork). You do not need to use trademark symbols with other Oracle trademarks.

Example: XYZ Develops New Product for Oracle® Database
XYZ Corporation, a member of the Oracle® PartnerNetwork program, has developed the ABC software cartridge for use with the industry leading Oracle database. The ABC software cartridge is one of numerous products XYZ has developed that complement leading Oracle offerings.

“Oracle” receives a trademark symbol in the headline because this is the most prominent appearance, and when it appears as part of the “Oracle PartnerNetwork” name because this is the first appearance in text. While there is no trademark symbol after “Oracle” when it appears in front of the term “products” and “offerings” since we already used a symbol the first time that the term “Oracle” appeared in body copy. It is always acceptable to continue using the ® after “Oracle” throughout the document.

Credit Line
All products, packaging, manuals, advertisements, promotional materials and Web pages bearing Oracle trademarks should include the following trademark credit line.

“Oracle and Java are registered trademarks of Oracle and/or its affiliates. Other names may be trademarks of their respective owners.”

The credit line may appear anywhere on the collateral, but typically is displayed on a copyright page, the back of a package or at the end of a document or web page.

“Oracle” As a Trade Name

Trade names are the actual business names of companies. Trademarks and trade names are not the same, even though many companies use their trade names as trademarks. If you are using “Oracle” as a substitute for Oracle Corporation, you are using it as a trade name. Because they are nouns, trade names can be used in the possessive and do not require a generic term or a trademark symbol. Thus, you should not use a ® after “Oracle” when it appears as part of the full corporate name or as a trade name.

Examples

  • Corporate Name: This software was developed by Oracle Corporation.
  • Trade Name: This software was developed by Oracle.
  • Trade Name: Oracle’s latest software developments are outstanding.
  • Trademark: The Oracle® database leads the industry.

Oracle’s logos, logotypes, signatures and design marks (“Oracle logos”) are valuable assets that Oracle needs to protect. Accordingly, we ask that you follow these guidelines with respect to Oracle logos. Remember that you are generally not able to use Oracle logos unless you are specifically licensed or authorized to use them. Logo Programs

  • A written summary setting forth: (a) your name and your company’s name; (b) contact information including phone number, fax number, email address and mailing address; (c) the specific Oracle logo that you wish to use; (d) background information on your company, detailing any relationship with Oracle; (e) the names of any Oracle contacts; (f) a description of your proposed use of the logo, including why you want to use the logo, where the logo would appear, the duration and geographical extent of the proposed use, how the logo would be displayed relative to your corporate name and logo, and whether the Oracle logo would be one of various logos appearing; (g) a description of Oracle’s involvement in any program or project in association with which you propose to use the Oracle logo; and (h) any previous correspondence you have had with Oracle regarding this logo request.
  • A mock-up or sample drawing showing your proposed use.

Following submission, Oracle will evaluate the request and contact you if additional information is necessary. You will then be notified whether the request is approved. The normal turnaround time for such requests is one week. If approval is granted, you will be sent formal written authorization to use the logo, electronic artwork and usage guidelines where appropriate.

Proper Use

Third parties expressly licensed or authorized to use Oracle logos must not alter or modify them in any way. Make sure to use Oracle approved artwork and refer to the appropriate identity guidelines provided by Oracle. Use must comply with the terms and conditions of your license or Oracle’s authorization.

Oracle does not want to receive confidential information from you through or in connection with the Site. Notwithstanding anything that you may note or state in connection with Sharing Content, it shall not be considered confidential information and shall be received and treated by Oracle on a non-confidential and unrestricted basis and Oracle shall not take and shall not be required to take any steps to safeguard the confidentiality of any information that you Share, other than as specified in Oracle’s Privacy Policy.

7. Security, Passwords and Means of Accessing the Site and Content
You agree not to access or use the Site in any manner that could damage, disable, overburden, or impair any Oracle accounts, computer systems or networks. You agree not to attempt to gain unauthorized access to any parts of the Site or any Oracle accounts, computer systems or networks. You agree not to interfere or attempt to interfere with the proper working of the Site or any Oracle accounts, computer systems or networks. You agree not to use any robot, spider, scraper or other automated means to access the Site or any Oracle accounts, computer systems or networks without Oracle’s express written permission.

If any of the Services require you to open an account, you must complete the registration process by providing us with current, complete and accurate information as required by the applicable registration form. You may also be required to choose a password and a user name. Access to and use of password protected or secure areas of the Site are restricted to authorized users only. You agree not to share your password(s), account information, or access to the Site with any other person. 9. Indemnity
You agree to indemnify and hold harmless Oracle, its officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses or expenses, including reasonable attorneys’ fees and costs, due to or arising out of Content that you Share, your violation of these Terms of Use or any additional rules, guidelines or terms of use posted for a specific area of the Site or Content provided on or through the Site, or your violation or infringement of any third party rights, including intellectual property rights.

10. Monitoring
Oracle has no obligation to monitor the Site or screen Content that is Shared on or through the Site. However, Oracle reserves the right to review the Site and Content and to monitor all use of and activity on the Site, and to remove or choose not to make available on or through the Site any Content in its sole discretion. Oracle may remove Content that is confidential or proprietary to a third party without that third party’s permission.

11. Termination of Use
Oracle may, in its sole discretion, at any time discontinue providing or limit access to the Site, any areas of the Site or Content provided on or through the Site. Third Party Usage Guidelines for Oracle Trademarks

Oracle’s trademarks and service marks (“Oracle trademarks”) are valuable assets that Oracle needs to protect. We ask that you help us by properly using and crediting Oracle trademarks in accordance with these guidelines. For information about proper use of Oracle logos, logotypes, signatures, and design marks, please review the Third Party Usage Guidelines for Oracle Logos.

Permissible Use

You may generally use Oracle trademarks to refer to the associated Oracle products or services. For instance, an authorized reseller can note in its advertisements that it is selling the Oracle application server. Similarly, an Oracle customer may issue a press release stating that it has implemented Oracle software.

Relationship of Products or Services
You may indicate the relationship of your products or services to Oracle products or services by using accurate, descriptive tag lines such as “for Oracle database,” “for use with Oracle E-Business Suite applications,” and “works with Oracle software” in connection with your product or service name. Within text or body copy, such tag lines may appear in the same type as your product or service name. On product, packaging, advertising and other collateral where your product or service name is displayed apart from body copy, make sure that the tag line appears in significantly smaller type than your name. You should also distinguish the tag line from your mark by using a different font or color. However, Oracle or the tag line should never appear in the Oracle red color. This is important to avert any implication that your product or service is produced or endorsed by Oracle.

Titles
Oracle permits use of its marks in single volume book titles (not magazines or periodicals) where such use is descriptive or referential. To avoid misleading the public as to Oracle sponsorship, affiliation or endorsement, the Oracle mark must not appear more prominently than the rest of the title, and do not use Oracle logos on the cover. In addition, we request that you include a disclaimer of association with Oracle on the copyright page.

Open Source Software
Most open source licenses do not grant, and many exclude, a license of trademark rights. Do not assume you can use the name of a source code base in the name of your distribution developed from that code base. Without a license or permission, you may not incorporate Oracle trademarks in the name of your distribution or other products that incorporate open source elements. Truthful statements incorporating a trademark are generally allowed (for example, in the format “MyImplementation, derived from Trademarked ProductName”), but you should check the terms of the license for the original source code or any posted trademark guidelines for the project.

User Groups
Oracle generally permits use of its marks in groups name that include phrases such as “user group,” “special interest group,” “lobby,” etc., that clarify the relationship between Oracle and the group and do not create confusion about the source of products. This applies only to user groups that are not formally doing business as commercial entities. If you are administering a user group that includes an Oracle trademark in its name, do not claim any trademark rights in the name or attempt to register the name or your logo with a trademark office, and do not register the name as a trade name or business name, or conduct any business under the name.

Prohibited Use

You may not use Oracle trademarks in a manner which could cause confusion as to Oracle sponsorship, affiliation or endorsement. Take particular care not to use Oracle marks as set out below.

Company, Product or Service Names
Do not use Oracle trademarks or potentially confusing variations as all or part of your company, product or service names. If you wish to note the relationship of your products or services to Oracle products or services, please use an appropriate tag line as detailed above. For example, “XYZ for Oracle database” not “OraXYZ or XYZ Oracle”

Logos
For more information regarding use of Oracle logos, please review the Third Party Usage Guidelines for Oracle Logos.

Trade Dress
You must not imitate Oracle trade dress, type style or logos. For instance, do not copy Oracle packaging for use with your product or display your product name in the distinctive logotype associated with the Oracle logo.

Domain Names
Do not use Oracle trademarks or potentially confusing variations in your Internet domain name. This helps prevent Internet users from being confused as to whether you or Oracle is the source of the Web site.

Correct Use

Proper use of Oracle trademarks reinforces their role as brands for our products and services, and helps prevent them from becoming generic names that can be used by anyone. Examples of former trademarks that became generic terms are “aspirin,” “cellophane,” and “escalator.” By adhering to the following rules, you help protect Oracle’s investment in its trademarks.

Use a Generic Term
Use a generic term in association with each Oracle trademark the first time the mark appears in text, and as often as possible after that. You need not include generic names in headlines, package titles and documentation titles. For example, “Oracle iLearning software”, “Oracle On Demand services”, and “Oracle database.”

Use as Adjectives
Oracle trademarks are adjectives and should not be used as nouns, or in the possessive or plural form. For example, “Oracle database’s benefits..” not “Oracle’s benefits…”

Avoid Variations
Do not vary Oracle trademarks by changing their spelling or abbreviating them. For example, “Oracle Collaboration Suite” not “CollabSuite.”

Trademark Symbols and Credit Lines

Proper trademark attribution through trademark symbols and credit lines helps makes the public aware of our trademarks, and helps prevent them from becoming generic terms. Credit lines also help clarify that they belong to Oracle. Accordingly, Oracle would appreciate you attributing ownership of Oracle trademarks to Oracle Corporation by using trademark symbols (™ or SM or ®) and credit lines as detailed below.

Trademark Symbols
Use the ® symbol with the most prominent appearance of the “Oracle” mark on products, packaging, manuals, advertisements, promotional materials and Web pages (for example, in the headline of an advertisement), and the first use of the mark in text or body copy. This includes situations where “Oracle” is a part of a product or service name (for example, Oracle® Collaboration Suite, Oracle® PartnerNetwork). You do not need to use trademark symbols with other Oracle trademarks.

Example: XYZ Develops New Product for Oracle® Database
XYZ Corporation, a member of the Oracle® PartnerNetwork program, has developed the ABC software cartridge for use with the industry leading Oracle database. The ABC software cartridge is one of numerous products XYZ has developed that complement leading Oracle offerings.

“Oracle” receives a trademark symbol in the headline because this is the most prominent appearance, and when it appears as part of the “Oracle PartnerNetwork” name because this is the first appearance in text. While there is no trademark symbol after “Oracle” when it appears in front of the term “products” and “offerings” since we already used a symbol the first time that the term “Oracle” appeared in body copy. It is always acceptable to continue using the ® after “Oracle” throughout the document.

Credit Line
All products, packaging, manuals, advertisements, promotional materials and Web pages bearing Oracle trademarks should include the following trademark credit line.

“Oracle and Java are registered trademarks of Oracle and/or its affiliates. Other names may be trademarks of their respective owners.”

The credit line may appear anywhere on the collateral, but typically is displayed on a copyright page, the back of a package or at the end of a document or web page.

“Oracle” As a Trade Name

Trade names are the actual business names of companies. Trademarks and trade names are not the same, even though many companies use their trade names as trademarks. If you are using “Oracle” as a substitute for Oracle Corporation, you are using it as a trade name. Because they are nouns, trade names can be used in the possessive and do not require a generic term or a trademark symbol. Thus, you should not use a ® after “Oracle” when it appears as part of the full corporate name or as a trade name.

Examples

  • Corporate Name: This software was developed by Oracle Corporation.
  • Trade Name: This software was developed by Oracle.
  • Trade Name: Oracle’s latest software developments are outstanding.
  • Trademark: The Oracle® database leads the industry.

Oracle’s logos, logotypes, signatures and design marks (“Oracle logos”) are valuable assets that Oracle needs to protect. Accordingly, we ask that you follow these guidelines with respect to Oracle logos. Remember that you are generally not able to use Oracle logos unless you are specifically licensed or authorized to use them. Information regarding Logo programs under which you may be licensed to use Oracle logos and information on obtaining other authorization is set out below.

Logo Programs

Qualified third parties are able to license the right to use select Oracle logos under Oracle logo programs. More information on these programs can be found by going to the web pages set out below or emailing the referenced email addresses.

Oracle PartnerNetwork Membership Logo
For use by Oracle PartnerNetwork (OPN) members. Partners can obtain more information at OPN Membership Logos, or e-mail opncomms_ww@oracle.com. Included are “Oracle Validated Integration” program logos providing validation testing for the integration of partner solutions with Oracle applications.

Oracle Certified Professional Logo
For use by Oracle Certified Professionals. Individuals wanting more information should go to the Oracle Certificationwebsite.

Oracle Academic Initiative and Oracle Workforce Development Program Logos
For use by education partners. Information regarding these education partner initiatives can be obtained at the Oracle Academic Initiative and Workforce Development Program websites.

If you wish to use an Oracle logo and are an Oracle Partner, please get in touch with your regular Oracle contact who should work directly with Oracle Partner Marketing. If you do not have a regular contact, please forward the following to opncomms_ww@oracle.com. If you are not an Oracle Partner, please forward the following to trademar_us@oracle.com.

  • A written summary setting forth: (a) your name and your company’s name; (b) contact information including phone number, fax number, email address and mailing address; (c) the specific Oracle logo that you wish to use; (d) background information on your company, detailing any relationship with Oracle; (e) the names of any Oracle contacts; (f) a description of your proposed use of the logo, including why you want to use the logo, where the logo would appear, the duration and geographical extent of the proposed use, how the logo would be displayed relative to your corporate name and logo, and whether the Oracle logo would be one of various logos appearing; (g) a description of Oracle’s involvement in any program or project in association with which you propose to use the Oracle logo; and (h) any previous correspondence you have had with Oracle regarding this logo request.
  • A mock-up or sample drawing showing your proposed use.

Following submission, Oracle will evaluate the request and contact you if additional information is necessary. You will then be notified whether the request is approved. The normal turnaround time for such requests is one week. If approval is granted, you will be sent formal written authorization to use the logo, electronic artwork and usage guidelines where appropriate.

Proper Use

Third parties expressly licensed or authorized to use Oracle logos must not alter or modify them in any way. Make sure to use Oracle approved artwork and refer to the appropriate identity guidelines provided by Oracle. Use must comply with the terms and conditions of your license or Oracle’s authorization.
